Amnesty International fears that Oleg Satanovich Moldagaliyev is facing imminent execution after the President of Kazakhstan turned down his petition for clemency.

Amnesty International has learned that on 19 June 1995 Oleg Moldagaliyev was being transferred from death row in Zapadnaya Kazakhstanskaya region to a prison in Almaty, the capital of Kazakhstan, which has facilities to carry out executions. According to information received from the procuracy of Kazakhstan execution is normally carried out three to five days after the prisoner's arrival at the place of execution.

Oleg Moldagaliyev was sentenced to death on 16 June 1994 by the Zapadnaya Kazakhstanskaya Regional Court for his part in a murder following a

retrial. He had previously been sentenced to eight years for the same crime. The Supreme Court of Kazakhstan upheld the death sentence on 28 September 1994 and on 29 March 1995 Oleg Moldagaliyev's relatives were informed that his petition for clemency had been turned down by the President of Kazakhstan.

Amnesty International is opposed to the death penalty in all cases and without reservation on the grounds that it is a violation of the right to life and the right not to be subjected to cruel, inhuman or degrading treatment or punishment as proclaimed in the Universal Declaration of Human Rights.

RECOMMENDED ACTION: Please send telegrams/faxes/express and airmail letters either in English, Russian or in your own language:

- urging President Nazarbayev to reconsider his decision not to grant clemency to Oleg Moldagaliyev, and to commute his death sentence;

- urging President Nazarbayev to commute all other death sentences that come before him.
