“Disappearances” and political killings: human rights crisis of the 1990s – a manual for action (pre-publication version): Chapter G-5: Bringing the perpetrators to justice

This chapter of a major forthcoming AI report examines the duty of the state to ensure that those responsible for extrajudicial executions and “disappearances” are brought to justice. It reports on measures to overcome impunity, ensuring that the judicial process incorporates certain standards and that the judiciary is independent. It calls for the establishment of the full scope of liability to prosecution including that of state responsibility, based on the judgement in the Velasquez Rodriguez case. It also looks at civil suits and the provision of compensation, rehabilitation and redress. Finally it reports on dealing with abuses committed under past regimes, giving several individual country examples.
