This paper considers whether there are any special arguments which would justify limiting the abolition of the death penalty to ordinary crimes. It presents arguments for and against the death penalty for wartime offences and includes a brief review of the subject from the point of view of international law. An appendix provides a summary of existing provisions on the death penalty for exceptional offences in the legislation of states where this penalty has been abolished for ordinary crimes.
