On 12 May 1993 Milorad Mutaşcu was released by the County Court of Timişoara from pre-trial detention. According to his lawyer, Milorad Mutaşcu was not ill-treated by police officers while in detention.

The trial of Milorad Mutaşcu and Mirel Ciprian Cucu, who have been charged solely for their homosexuality under Article 200 of the Romanian Penal Code, has been postponed until 9 June 1993.

Should Milorad Mutaşcu and Mirel Ciprian Cucu, after the trial on 9 June 1993, be again imprisoned Amnesty International would consider them to be prisoners of conscience.

FURTHER RECOMMENDED ACTION: Please send telegrams/telexes/faxes/express and airmail letters either in English, French, German or your own language:

- expressing concern that Mirel Ciprian Cucu and Milorad Mutaşcu have been arrested and charged solely for their homosexuality;

- pointing out that both men would be prisoners of conscience if convicted and sentenced to imprisonment solely because of their consensual relations in private, which are the basis of the charges;

- urging the authorities to ensure that the planned reform of the Penal Code removes provisions in Article 200 by which people can be imprisoned solely by reason of their homosexuality.
