Amnesty International fears that Sergey Vladimirovich Kutyavin faces imminent execution unless the Presidential Clemency Commission of Belarus reconsiders its decision to uphold his death sentence and recommends that the President exercises his constitutional authority to commute this death sentence.
Sergey Kutyavin was sentenced to death for murder by Mogilev Regional Court on 19 July 1993. His appeal against his death sentence was rejected by the Supreme Court of Belarus on 11 March 1994. His petition for clemency was turned down by the Presidential Clemency Commission on 15 December 1994. It is not clear whether the President has already signed the execution order for Sergey Kutyavin. He was still alive on 18 January 1995 when his mother visited him in prison. He could, however, be executed at any time.
Amnesty International opposes the death penalty in all cases and without reservation, on the grounds that it is a violation of the right to life and the right not to be subjected to cruel, inhuman or degrading treatment or punishment as proclaimed in the Universal Declaration of Human Rights.
FURTHER RECOMMENDED ACTION: Please send telegrams/telexes/faxes/express and airmail letters:
- expressing regret at the Clemency Commission's decision to uphold Sergey Kutyavin's death sentence;
- calling on the Clemency Commission to reconsider it's decision on Sergey Kutyavin's fate and recommend that the President commute his death sentence;
- urging the President to exercise his constitutional authority and stop the execution of Sergey Kutyavin;
- urging the President to commute all other death sentences that come before him.
